What You Need to Know About Infant Formula
Abbott Laboratories, makers of Similac, and Mead Johnson & Company, LLC, makers of Enfamil, face an ever-growing number of lawsuits filed by distraught parents whose premature newborns suffered or died after using the companies’ cow’s milk-based infant formulas.
Both manufacturers knew their cow’s milk-based formulas were capable of causing premature infants to develop necrotizing enterocolitis, a deadly intestinal disease. Still, they continued mass-marketing and selling the potentially harmful formulas without informing parents about their life-threatening side effects, making no mention of the dangers on their products’ warning labels or any other means.

Infant Formula Lawsuit FAQs
Have Similac and Enfamil Formulas Been Recalled?
In regard to their connection with NEC, no, Enfamil and Similac have not been recalled.
In early 2022, Abbott Nutrition did voluntarily recall a few lots of their formulas manufactured in their Sturgis, MI, after four babies suffered Cronobacter sakazakii infections and one baby became infected with Salmonella Newport. Two of the babies died, and the FDA and Abbott are still investigating.
Currently, The FDA is advising consumers to not use Similac, Alimentum, or EleCare powdered infant formulas if:
- The first two digits of the code on the container are 22 through 37
- The code contains K8, SH or Z2
- The expiration date is April 1, 2022 or later
Can NEC Affect Babies Born at Full Term?
While NEC most commonly affects babies born prematurely, yes, full-term infants can still be diagnosed with NEC. It’s rare for babies born at weights above three or four pounds to develop NEC, but it’s still a possibility.
What Are The Symptoms of NEC?
Symptoms of NEC include metabolic acidosis, abdominal distention, feeding intolerance, feeding residuals, jaundice, green fluid in the abdominal wall, lethargy, decreased bowel sounds, an increase or decrease in stools, trouble breathing, acidosis, and bradycardia (slow heart rate).
NEC is progressive so identifying symptoms for prompt treatment is critical. With prompt diagnosis and treatment, most babies with NEC do well and have a normal life expectancy without complications.
NEC is initially diagnosed based on clinical observation of symptoms by a pediatrician. If your baby has presented these symptoms after being fed one of the Enfamil or Similac formulas linked to NEC, it’s time to get in touch with an attorney who can help you seek justice for your baby.
Is There a Class Action Lawsuit for Infant Formula and NEC?
As of April 11, 2022, there is an NEC baby formula class action lawsuit in federal court. The Judicial Panel on Multidistrict Litigation (JPML) issued a transfer order that consolidates all pending NEC infant formula lawsuits into a new mass tort MDL (multidistrict litigation),
